District Attorney, Ashley E. Smith, announced today that the following people were indicted by the Cattaraugus County Grand Jury for the month of February 2026:

  • City of Olean, New York- William K. Eisenhart, was indited on February 13, 2026, for Criminal Possession of a Controlled Substance in the Third Degree (Class B Felony) and Aggravated Unlicensed Operation of a Motor Vehicle in the First Degree (Class E Felony).  The indictment states that on or about September 6, 2025, Eisenhart knowingly and unlawfully possessed a stimulant weighing five grams or more and Eisenhart knowingly and unlawfully operated a motor vehicle on a public roadway while his license was suspended or revoked.     
  • City of Salamanca, New York- Brett M. Williams was indicted on February 13, 2026, for two counts of Driving While Intoxicated (Class E Felony), Aggravated Unlicensed Operation of a Motor Vehicle in the First degree (Class E Felony), Interlock Violation (Misdemeanor), and Failure to Signal (Violation). The indictment states that on or about September 1, 2025, Williams operated a motor vehicle while he was in an intoxicated condition, and when he had a BAC of .08 or more and operated a motor vehicle while his license was suspended or revoked as a result of an alcohol related offense, and the defendant was operating the vehicle while under the influence of alcohol in violation of one the subdivisions of Vehicle and Traffic Law. Williams, while subject to a court ordered ignition interlock, operated a motor vehicle without being equipped with an ignition interlock device and failed to signal before turning. 
  • City of Olean, New York – John Shayne-Arthur Emond Jr. was indicted on February 13, 2026, for Burglary in the Third Degree (Class D Felony), Criminal Mischief in the Third Degree (Class E Felony), Petit Larceny (Class A Misdemeanor), Criminal Possession of Stolen Property in the Fifth Degree (Class A Misdemeanor), Criminal Tampering in the Third Degree (Class B Misdemeanor), and Escape in the Third Degree (Class A Misdemeanor). The indictment states that on or about August 30, 2025, Emond Jr. knowingly entered or remained unlawfully in a building, with intent to commit a crime and with intent to damage property of another person in an amount exceeding two hundred and fifty dollars ($250.00), stole property, knowingly possessed stolen property, and Emond Jr. unlawfully tampered with property of another person with intent to cause substantial inconvenience to such person or to a third person. The indictment also states that on or about December 11, 2025, Emond Jr. escaped from custody. 
  • Town of Perrysburg, New York – Michael E. Knowles, Jason P. John, and Angela Chmiel were indicted on February 26, 2026, for Criminal Possession of a Controlled Substance in the Third Degree (Class B Felony), Criminal Possession of a Controlled Substance in the Fourth Degree (Class C Felony), Criminal Possession of a Controlled Substance in the Seventh Degree (Class A Misdemeanor), and Criminal Use of Drug Paraphernalia in the Second Degree (Class A Misdemeanor). The indictment states that on or about September 10, 2025, Knowles, John, and Chmiel knowingly and unlawfully possessed a narcotic drug with the intent to sell, knowingly and unlawfully possessed crack cocaine with an aggregated weight of one-eighth ounce or more, and possessed scales and balances used or designed for the purpose of weighing and measuring controlled substances, for purpose of unlawfully manufacturing, packaging, or dispensing of any narcotic, drug, or stimulant.
